Health and Safety Code § 444.003","heading":"ELIGIBLE PRESCRIPTION DRUGS.","body":"A prescription drug may be imported into this state under the program only if the drug:\n(1) meets the United States Food and Drug Administration's standards related to prescription drug safety, effectiveness, misbranding, and adulteration;\n(2) does not violate any federal patent laws through its importation;\n(3) is expected to generate cost savings for consumers; and\n(4) is not:\n(A) listed as a controlled substance under state or federal law;\n(B) a biological product;\n(C) an infused drug;\n(D) an intravenously injected drug;\n(E) a drug that is inhaled during surgery; or\n(F) a parenteral drug.\nAdded by Acts 2023, 88th Leg., R.S., Ch. 655 (H.B. 25), Sec. 2, eff.
