Health and Safety Code § 773.065","heading":"ADMINISTRATIVE PENALTY.","body":"(a) The department may assess an administrative penalty against an emergency medical services provider or a course coordinator who violates this chapter or a rule adopted or an order issued under this chapter.\n(b) In determining the amount of the penalty, the department shall consider:\n(1) the emergency medical services provider's or course coordinator's previous violations;\n(2) the seriousness of the violation;\n(3) any hazard to the health and safety of the public;\n(4) the emergency medical services provider's or course coordinator's demonstrated good faith; and\n(5) any other matter as justice may require.\n(c) The penalty may not exceed $7,500 for each violation. The executive commissioner by rule shall establish gradations of penalties in accordance with the relative seriousness of the violation.\n(d) Each day a violation continues may be considered a separate violation.\nAdded by Acts 1991, 72nd Leg., ch. 605, Sec. 7, eff.
