Human Resources Code § 23.004","heading":"INITIATION OF PROCEEDING.","body":"(a) The commission may initiate a proceeding to suspend a person's license by filing a petition with the commission's appeals division.\n(b) The proceeding shall be conducted by the commission's appeals division. The proceeding is a contested case under Chapter 2001, Government Code, except that Section 2001.054 does not apply.\n(c) The executive commissioner or the executive commissioner's designated representative shall render a final decision or order in the proceeding. A reference to the commission in this chapter with respect to a final decision or order in the proceeding means the executive commissioner or the executive commissioner's designated representative.\nAdded by Acts 1997, 75th Leg., ch. 1153, Sec. 5.01(a), eff.
