Human Resources Code § 40.054","heading":"ACCESS TO CRIMINAL HISTORY.","body":"Subject to the availability of funds appropriated by the legislature, the department is entitled to obtain any criminal history information from records maintained by:\n(1) the Department of Public Safety, as prescribed by Section 411.114, Government Code;\n(2) another law enforcement agency in this state, subject to the same procedures and limitations prescribed by Section 411.114, Government Code, as applicable; or\n(3) federal agencies, as provided by federal law.\nAdded by Acts 1995, 74th Leg., ch. 920, Sec. 1, eff.
