Insurance Code § 1369.104","heading":"EXCLUSION OR LIMITATION PROHIBITED.","body":"(a) A health benefit plan that provides benefits for prescription drugs or devices may not exclude or limit benefits to enrollees for:\n(1) a prescription contraceptive drug or device approved by the United States Food and Drug Administration; or\n(2) an outpatient contraceptive service.\n(b) This section does not prohibit a limitation that applies to all prescription drugs or devices or all services for which benefits are provided under a health benefit plan.\n(c) This section does not require a health benefit plan to cover abortifacients or any other drug or device that terminates a pregnancy.\nAdded by Acts 2003, 78th Leg., ch. 1274, Sec. 3, eff.
