Insurance Code § 1379.004","heading":"EXCEPTION.","body":"This chapter does not apply to:\n(1) a plan that provides coverage:\n(A) for wages or payments in lieu of wages for a period during which an employee is absent from work because of sickness or injury;\n(B) as a supplement to a liability insurance policy;\n(C) for credit insurance;\n(D) for a specified disease or diseases;\n(E) only for dental or vision care;\n(F) only for hospital expenses; or\n(G) only for indemnity for hospital confinement;\n(2) a Medicare supplemental policy as defined by Section 1882(g)(1), Social Security Act (42 U.S.C. Section 1395ss);\n(3) a workers' compensation insurance policy;\n(4) medical payment insurance coverage provided under a motor vehicle insurance policy; or\n(5) a long-term care policy, including a nursing home fixed indemnity policy, unless the commissioner determines that the policy provides benefit coverage so comprehensive that the policy is a health benefit plan as described by Section 1379.002.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 719 (S.B. 39), Sec. 1, eff.
