Insurance Code § 2054.352","heading":"REQUIRED DECLINATION OF CERTAIN RISKS.","body":"(a) In this section, \"good faith\" means honesty in fact in any conduct or transaction.\n(b) The company shall decline to insure a risk if:\n(1) insuring the risk would cause the company to exceed the premium-to-surplus ratios established by Section 2054.156; or\n(2) the risk is not, in good faith, entitled to insurance through the company.\nAdded by Acts 2005, 79th Leg., Ch. 727 (H.B. 2017), Sec. 2, eff.
