Insurance Code § 2203.202","heading":"RATE STANDARDS.","body":"(a) In determining rates, rating plans, rating rules, rating classifications, territories, and policy forms, the association shall consider:\n(1) the past and prospective loss and expense experience for medical professional liability insurance, inside and outside this state, of all of the association members;\n(2) trends in the frequency and severity of losses;\n(3) the association's investment income; and\n(4) other information the commissioner may require.\n(b) Rates, rating plans, and rating rules must be based on:\n(1) the association's loss and expense experience; and\n(2) other information based on that experience the department considers appropriate.\n(c) The resultant premium rates must be:\n(1) actuarially sound; and\n(2) computed to be self-supporting.\nAdded by Acts 2005, 79th Leg., Ch. 727 (H.B. 2017), Sec. 2, eff.
