Insurance Code § 545.054","heading":"INQUIRIES REGARDING PREVIOUS TESTS.","body":"(a) An issuer may inquire whether an applicant has:\n(1) tested positive on an HIV-related test; or\n(2) been diagnosed with HIV or AIDS.\n(b) An issuer may not inquire whether an applicant has been tested for or has received a negative result from a specific test for:\n(1) exposure to HIV; or\n(2) a sickness or a medical condition derived from infection with HIV.\nAdded by Acts 2003, 78th Leg., ch. 1274, Sec. 2, eff.
