Labor Code § 352.058","heading":"SUBROGATION.","body":"(a) By providing a person rehabilitation services, including medical care services, under this subchapter, the commission is subrogated to the person's right of recovery from:\n(1) personal insurance;\n(2) another person for personal injury caused by the other person's negligence or wrongdoing; or\n(3) any other source.\n(b) The commission's right of subrogation is limited to the cost of the services provided.\n(c) The commission may totally or partially waive the commission's right of subrogation when the commission finds that enforcement would tend to defeat the purpose of rehabilitation.\n(d) The commission may adopt rules for the enforcement of the commission's right of subrogation.\nAdded by Acts 2015, 84th Leg., R.S., Ch. 1138 (S.B. 208), Sec. 25, eff.
