Natural Resources Code § 134.056","heading":"SMALL MINE EXEMPTION.","body":"The commission shall designate a qualified public or private laboratory to prepare the determination of probable hydrologic consequences and statement of the results of test borings or core samplings required by Section 134.052 and shall pay the costs of preparing the determination and statement if:\n(1) a surface coal mining operator makes a request in writing; and\n(2) the commission finds that the probable total annual production at all locations of the surface coal mining operator will not exceed 300,000 tons.\nAdded by Acts 1995, 74th Leg., ch. 76, Sec. 12.02(a), eff.
