Occupations Code § 1201.355","heading":"CONSUMER COMPLAINT HOME INSPECTION.","body":"(a) If the manufacturer, retailer, or installer does not provide the consumer with proper warranty service, the consumer may, at any time, request the department to perform a consumer complaint home inspection. The department may not charge a fee for the inspection.\n(b) On payment of the required inspection fee, the manufacturer, retailer, or installer may request the department to perform a consumer complaint home inspection if the manufacturer, retailer, or installer:\n(1) believes the consumer's complaints are not covered by the warranty of the manufacturer, retailer, or installer, as applicable;\n(2) believes that the warranty service was properly provided; or\n(3) disputes responsibility concerning the warranty obligation.\n(c) The department shall perform a consumer complaint home inspection not later than the 30th day after the date of receipt of a request for the inspection.\n(d) Notwithstanding any other provision of this section, the department may make an inspection at any time if it believes that there is a reasonable possibility that a condition exists that would present an imminent threat to health or safety.\nAdded by Acts 2001, 77th Leg., ch. 1421, Sec. 2, eff.
