Occupations Code § 1702.3835","heading":"DECEPTIVE TRADE PRACTICE.","body":"(a) A person who performs or offers to perform an activity regulated under this chapter, but who is not licensed or otherwise authorized under this chapter to perform the activity, commits a false, misleading, or deceptive act or practice within the meaning of Section 17.46, Business \u0026 Commerce Code.\n(b) A public or private right or remedy under Chapter 17, Business \u0026 Commerce Code, may be used to enforce this chapter.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 1146 (H.B. 2730), Sec. 4B.20, eff.
