Occupations Code § 2033.013","heading":"TOUTING.","body":"(a) A person commits an offense if, with an intent to deceive and an intent to obtain a benefit, the person knowingly:\n(1) makes a false statement about a horse or greyhound race to another person; or\n(2) offers, agrees to convey, or conveys false information about a horse or greyhound race to another person.\n(b) Except as provided by Subsection (c), an offense under this section is a Class A misdemeanor.\n(c) An offense under this section is a state jail felony if:\n(1) the actor:\n(A) is a license holder under this subtitle or a commission member or employee; and\n(B) knowingly represents that a commission member or employee or a person licensed by the commission is the source of the false information; or\n(2) the false statement or information was contained in racing selection information provided to the public.\nAdded by Acts 2017, 85th Leg., R.S., Ch. 963 (S.B. 1969), Sec. 1.01, eff.
