Occupations Code § 2051.451","heading":"ADMINISTRATIVE PENALTY.","body":"(a) If the secretary of state determines that a person regulated under this chapter has violated this chapter or a rule adopted under this chapter in a manner that constitutes a ground for disciplinary action under Section 2051.405, the secretary may assess an administrative penalty against the person as provided by this subchapter.\n(b) The secretary shall determine the amount of a penalty assessed under Subsection (a), except that the amount may not exceed:\n(1) $50,000 for a violation of Section 2051.351(a)(7) or (14); or\n(2) $25,000 for any other violation.\n(c) In determining the amount of a penalty under Subsection (b), the secretary shall consider the seriousness of the violation.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
