Occupations Code § 2051.452","heading":"INVESTIGATION AND PRELIMINARY REPORT.","body":"(a) If, after examining a possible violation, including facts relating to the violation, the secretary of state determines that a person has committed a violation of this chapter, the secretary shall issue a preliminary report stating:\n(1) the facts on which the determination is based; and\n(2) that an administrative penalty will be imposed, including the amount of the penalty.\n(b) The secretary shall, not later than the 10th day after the date a preliminary report is issued under Subsection (a), send to the person who is the subject of the report:\n(1) a copy of the report; and\n(2) notice that the person may request a hearing under Section 2051.453.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
