Occupations Code § 2154.053","heading":"RULES RESTRICTING ADVERTISING OR COMPETITIVE BIDDING.","body":"(a) The commissioner may not adopt rules restricting advertising or competitive bidding by a license or permit holder under this chapter except to prohibit false, misleading, or deceptive practices.\n(b) The commissioner may not include in the rules to prohibit false, misleading, or deceptive practices a rule that:\n(1) restricts the use of any advertising medium;\n(2) restricts the holder's personal appearance or the use of a holder's voice in an advertisement;\n(3) relates to the size or duration of an advertisement by the holder; or\n(4) restricts the holder's advertisement under a trade name.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
