Occupations Code § 2302.353","heading":"OFFENSES.","body":"(a) A person commits an offense if the person knowingly violates:\n(1) a provision of this chapter other than Subchapter G; or\n(2) a rule adopted under a provision of this chapter other than Subchapter G.\n(b) A person commits an offense if the person knowingly violates Subchapter G.\n(c) An offense under Subsection (a) is a Class A misdemeanor unless it is shown on the trial of the offense that the defendant has been previously convicted of an offense under that subsection, in which event the offense is punishable as a state jail felony.\n(d) An offense under Subsection (b) is a Class C misdemeanor.\nAdded by Acts 2001, 77th Leg., ch. 1421, Sec. 5, eff.
