Occupations Code § 2303.054","heading":"RULES RESTRICTING ADVERTISING OR COMPETITIVE BIDDING.","body":"(a) The commission may not adopt a rule restricting advertising or competitive bidding by a person licensed under this chapter except to prohibit a false, misleading, or deceptive practice.\n(b) In its rules to prohibit a false, misleading, or deceptive practice, the commission may not include a rule that:\n(1) restricts the person's use of any advertising medium;\n(2) restricts the person's personal appearance or the use of the person's voice in an advertisement;\n(3) relates to the size or duration of an advertisement by the person; or\n(4) restricts the person's advertisement under a trade name.\nAdded by Acts 2001, 77th Leg., ch. 1421, Sec. 5, eff.
