Occupations Code § 2310.001","heading":"DEFINITIONS.","body":"(a) In this chapter:\n(1) \"Automotive fuel rating\" has the meaning assigned by 15 U.S.C. Section 2821.\n(2) \"Commission\" means the Texas Commission of Licensing and Regulation.\n(3) \"Dealer\" means a person who is the operator of a retail motor fuel facility.\n(4) \"Department\" means the Texas Department of Licensing and Regulation.\n(4-a) \"Distributor\" means a person who makes retail or wholesale sales of motor fuel.\n(5) \"Executive director\" means the executive director of the department.\n(5-a) \"Measuring device\" means a mechanical or electronic device used to:\n(A) dispense or deliver a motor fuel by volume, flow rate, or other measure; or\n(B) compute the charge for a service related to motor fuel.\n(6) \"Motor fuel\" has the meaning assigned by Section 162.001, Tax Code.\n(7) \"Motor fuel metering device\" means a measuring device used for commercial motor fuel sales.\n(8) \"Operator\" or \"user\" means a person in possession or control of a measuring device, including an owner, custodian, or seller.\n(9) \"Sell\" includes barter or exchange.\n(9-a) \"Supplier\" has the meaning assigned by Section 162.001, Tax Code.\n(9-b) \"Wholesaler\" means a person who purchases tax-paid motor fuel for resale or distribution at wholesale.\nAdded by Acts 2019, 86th Leg., R.S., Ch. 1219 (S.B. 2119), Sec. 1, eff.
