Occupations Code § 2310.053","heading":"EXEMPTION OF CERTAIN MOTOR FUEL METERING DEVICES.","body":"(a) The commission by rule may exempt a motor fuel metering device from a requirement established by this chapter if the commission determines that imposing or enforcing the requirement:\n(1) is not cost-effective for the department;\n(2) is not feasible with current resources or standards; or\n(3) will not substantially benefit or protect consumers.\n(b) A motor fuel metering device is exempt from the requirements of this chapter if the motor fuel metering device is not used to:\n(1) calculate the amount of motor fuel sold in a commercial transaction; or\n(2) compute the charge for service.\n(c) Notwithstanding Section 2310.002, this chapter does not apply to a weighing or measuring device, as defined by Section 13.001, Agriculture Code, that measures liquefied petroleum gas.\nAdded by Acts 2019, 86th Leg., R.S., Ch. 1219 (S.B. 2119), Sec. 1, eff.
