Occupations Code § 301.470","heading":"REFUND.","body":"(a) Subject to Subsection (b), the board may order a license holder to pay a refund to a consumer as provided in an agreement resulting from an informal settlement conference instead of or in addition to imposing an administrative penalty under this chapter.\n(b) The amount of a refund ordered as provided in an agreement resulting from an informal settlement conference may not exceed the amount the consumer paid to a nurse for a service regulated by this chapter or the actual amount stolen or defrauded from a patient by the nurse. The board may not require payment of other damages or estimate harm in a refund order.\nAdded by Acts 2007, 80th Leg., R.S., Ch. 889 (H.B. 2426), Sec. 28, eff.
