Occupations Code § 351.503","heading":"DISCIPLINARY PROCEEDINGS.","body":"(a) A person may initiate disciplinary proceedings under Section 351.501 by filing a charge with the board in writing and under oath.\n(b) A person is entitled to a hearing conducted by the State Office of Administrative Hearings if:\n(1) a charge is filed against the person; or\n(2) the board proposes to:\n(A) refuse the person's application for a license; or\n(B) suspend or revoke the person's license.\n(c) Disciplinary proceedings are governed by Chapter 2001, Government Code.\n(d) A charge filed under Section 351.502(a) must state each specific instance of alleged noncompliance. At a hearing on the charge, the person charged has the burden of establishing, in each instance in which proof of noncompliance is adduced, that compliance was not necessary to a proper examination of the patient in that particular case.\n(e) A charge filed under Section 351.502(b) must state each specific instance of alleged noncompliance.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
