Occupations Code § 353.101","heading":"PROHIBITED SELLING OR DISPENSING.","body":"(a) A person, other than the prescribing physician, optometrist, or therapeutic optometrist, may not fill a contact lens prescription or sell or dispense contact lenses to a consumer in this state unless the person:\n(1) receives from the prescribing physician, optometrist, or therapeutic optometrist or the consumer, directly or by facsimile, a contact lens prescription that has not expired and that conforms to the requirements of this chapter; or\n(2) verifies by direct communication a contact lens prescription to be filled.\n(b) A person receiving a direct communication under Subsection (a)(2) shall maintain a record of the communication.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
