Occupations Code § 402.104","heading":"POWERS AND DUTIES REGARDING EXAMINATION.","body":"(a) The department shall develop and maintain an examination that may include a written or practical test. The department shall administer or arrange for the administration and validation of the examination.\n(b) Repealed by Acts 2019, 86th Leg., R.S., Ch. 377 (H.B. 2699), Sec. 6(1), eff. September 1, 2019.\n(d) The practical test must be administered by one or more qualified proctors selected and assigned by the department.\n(e) The commission by rule shall establish the qualifications for a proctor. The rules must:\n(1) require a proctor to be licensed in good standing as a hearing instrument fitter and dispenser;\n(2) specify the number of years a proctor must be licensed as a hearing instrument fitter and dispenser; and\n(3) specify the disciplinary actions or other actions that disqualify a person from serving as a proctor.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
