Occupations Code § 51.204","heading":"RULES RESTRICTING ADVERTISING OR COMPETITIVE BIDDING.","body":"(a) The commission may not adopt rules restricting advertising or competitive bidding by a license holder except to prohibit false, misleading, or deceptive practices.\n(b) The commission may not include in rules to prohibit false, misleading, or deceptive practices by a license holder a rule that:\n(1) restricts the use of any advertising medium;\n(2) restricts the license holder's personal appearance or the use of the license holder's voice in an advertisement;\n(3) relates to the size or duration of an advertisement; or\n(4) restricts the use of a trade name in advertising.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
