Occupations Code § 603.153","heading":"RULES RESTRICTING ADVERTISING OR COMPETITIVE BIDDING.","body":"(a) The medical board may not adopt a rule restricting advertising or competitive bidding by a person regulated by the medical board under this chapter except to prohibit a false, misleading, or deceptive practice.\n(b) The medical board may not include in rules to prohibit a false, misleading, or deceptive practice by a person regulated by the medical board under this chapter a rule that:\n(1) restricts the person's use of any medium for advertising;\n(2) restricts the person's personal appearance or use of the person's voice in an advertisement;\n(3) relates to the size or duration of any advertisement by the person; or\n(4) restricts the use by the person of a trade name in advertising.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
