Occupations Code § 651.052","heading":"ELIGIBILITY OF PUBLIC MEMBERS.","body":"(a) A person may not be a public member of the commission if the person or the person's spouse:\n(1) is registered, certified, or licensed by a regulatory agency in the funeral service industry;\n(2) is employed by or participates in the management of a business entity or other organization regulated by or receiving money from the commission;\n(3) owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization regulated by or receiving money from the commission; or\n(4) uses or receives a substantial amount of tangible goods, services, or money from the commission, other than compensation or reimbursement authorized by law for commission membership, attendance, or expenses.\n(b) A public member of the commission may not, except as a consumer:\n(1) have a financial interest in a funeral establishment; or\n(2) be related to a person within the second degree by affinity or third degree by consanguinity, as determined under Subchapter B, Chapter 573, Government Code, who has a financial interest in a funeral establishment.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
