Occupations Code § 651.552","heading":"AMOUNT OF PENALTY.","body":"(a) The amount of the administrative penalty shall be not less than $100 or more than $5,000 for each violation.\n(b) In determining the amount of the penalty, the commission shall base its decision on:\n(1) the seriousness of the violation;\n(2) the threat the violation poses to health and safety;\n(3) the history of previous violations;\n(4) the amount necessary to deter a future violation;\n(5) efforts made to correct the violation;\n(6) the guidelines adopted under Section 651.5515; and\n(7) any other matter that justice requires.\nActs 1999, 76th Leg., ch. 388, Sec. 1, eff.
