Parks and Wildlife Code § 31.058","heading":"RIGHTS OF PURCHASER OTHER THAN SECURED PARTY.","body":"Text of section effective on January 01, 2028\n(a) In this section, \"buyer in ordinary course of business\" has the meaning assigned by Section 1.201, Business \u0026 Commerce Code.\n(b) A buyer in ordinary course of business has the protections afforded by Sections 2.403(b) and 9.320(a), Business \u0026 Commerce Code, regardless of whether:\n(1) an existing certificate of title was signed and delivered to the buyer; or\n(2) a new certificate of title listing the buyer as owner of record was issued.\n(c) Except as provided by Sections 31.053 and 31.0582, the rights of a purchaser of a vessel or outboard motor that is not a buyer in ordinary course of business or a lien creditor are governed by the Business \u0026 Commerce Code.\nAdded by Acts 2025, 89th Leg., R.S., Ch. 185 (S.B. 1267), Sec. 21, eff.
