Parks and Wildlife Code § 86.017","heading":"USE OF FUNDS.","body":"(a) Except as provided by Subsection (b), funds collected by the commission from the sale of marl, sand, gravel, shell, and mudshell may be used for:\n(1) the enforcement of the provisions of this chapter;\n(2) the payment of refunds;\n(3) the construction and maintenance of fish hatcheries; and\n(4) the enhancement, preservation, and restoration of fish habitats in rivers and streams.\n(b) No less than three-fourths of the proceeds from the sale of marl, sand, gravel, shell, and mudshell, after the payment of refunds, shall be used for:\n(1) the construction and maintenance of fish hatcheries; and\n(2) the enhancement, preservation, and restoration of fish habitats in rivers and streams.\nActs 1975, 64th Leg., p. 1405, ch. 545, Sec. 1, eff.
