Property Code § 82.151","heading":"APPLICABILITY.","body":"(a) This subchapter applies to each unit subject to this chapter, except as provided by Subsection (b) or as modified or waived by the agreement of a purchaser of a unit in a condominium in which all units are restricted to nonresidential use.\n(b) A condominium information statement or resale certificate need not be prepared or delivered in the case of:\n(1) a gratuitous disposition of a unit;\n(2) a disposition pursuant to court order;\n(3) a disposition by a government or governmental agency;\n(4) a disposition by foreclosure or deed in lieu of foreclosure; or\n(5) a disposition that may be canceled at any time, for any reason, and without penalty.\nAdded by Acts 1993, 73rd Leg., ch. 244, Sec. 1, eff.
