Special District Local Laws Code § 21.004","heading":"FINDINGS AND DECLARATION OF POLICY.","body":"(a) The legislature finds that:\n(1) the quality of water in East Texas is materially affected by the disposal of waste throughout the region;\n(2) a regional effort to study water pollution, plan corrective and preventive measures, provide coordinated facilities for waste disposal, and regulate waste disposal is far more effective than efforts on a smaller scale;\n(3) solid waste, as well as other waste, may impair water quality by seepage or drainage; and\n(4) creation of the district would advance the established policy of this state to maintain the quality of the water in the state consistent with:\n(A) public health and enjoyment;\n(B) the propagation and protection of terrestrial and aquatic life;\n(C) the operation of existing industries; and\n(D) the economic development of the state.\n(b) All area included in the district will benefit from the exercise of the power conferred by this chapter.\n(c) The district is a public entity performing an essential public function.\nAdded by Acts 2007, 80th Leg., R.S., Ch. 920 (H.B. 3166), Sec. 1.01, eff.
