Special District Local Laws Code § 3872.113","heading":"LIMITED EMINENT DOMAIN.","body":"(a) The district may exercise the power of eminent domain only for the purposes, only to the extent, and subject to the limitations the general law provides for a municipal utility district.\n(b) The district may not exercise the power of eminent domain outside the district to acquire a site or easement for:\n(1) a road project authorized by Section 3872.104; or\n(2) a recreational facility as defined by Section 49.462, Water Code.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 873 (S.B. 2511), Sec. 1, eff.
