Special District Local Laws Code § 3901.151","heading":"PUBLIC TRANSIT SYSTEM; PETITION REQUIRED.","body":"(a) The district may acquire, lease as lessor or lessee, construct, develop, own, operate, and maintain a public transit system to serve the area in the district.\n(b) The board may not act under Subsection (a) unless a written petition requesting the action has been filed with the board.\n(c) The petition must be signed by:\n(1) the owners of property representing a majority of the total assessed value of the real property in the district that abuts the right-of-way in which the public transit system is proposed to be located; or\n(2) the owners of a majority of the area of the real property in the district that abuts the right-of-way in which the public transit system is proposed to be located.\n(d) For purposes of Subsection (c), the determination of a majority is based on the property owners along the entire right-of-way of the proposed transit project and may not be calculated on a block-by-block basis.\nAdded by Acts 2011, 82nd Leg., R.S., Ch. 861 (H.B. 3842), Sec. 1, eff.
