Special District Local Laws Code § 8104.202","heading":"FACILITIES FOR WATER TRANSPORTATION AND DISTRIBUTION.","body":"(a) The authority may construct, maintain, and operate a canal, lateral, ditch, levee, pipeline, or other facility to transport and distribute water, together with a service road or other facility incidental to or designed for use in connection with transportation and distribution of water, under, along, and across a:\n(1) railroad;\n(2) railroad right-of-way;\n(3) canal;\n(4) stream;\n(5) pipeline;\n(6) utility line;\n(7) street or alley in a municipality, subject to reasonable regulation by the municipality; or\n(8) public road or highway.\n(b) In crossing a facility described by Subsection (a), the authority:\n(1) may not impair the use of the facility; and\n(2) shall promptly restore the facility to its former condition of usefulness.\nAdded by Acts 2005, 79th Leg., Ch. 729 (H.B. 2019), Sec. 1.06, eff.
