Special District Local Laws Code § 8109.158","heading":"LIMITATION ON USE OF EMINENT DOMAIN.","body":"(a) The district may only exercise the power of eminent domain described by Chapters 49 and 54, Water Code.\n(b) The district may not exercise the power of eminent domain outside the district to acquire a site or easement for:\n(1) a road project authorized by Section 8109.154; or\n(2) a recreational facility as defined by Section 49.462, Water Code.\n(c) The district may not exercise the power of eminent domain for an improvement project.\nAdded by Acts 2011, 82nd Leg., R.S., Ch. 1194 (H.B. 3845), Sec. 2, eff.
