Special District Local Laws Code § 8501.153","heading":"STATE SUPERVISION AND APPROVAL.","body":"(a) The Texas Commission on Environmental Quality shall consider the adequacy of, and decide whether to approve, any flood control or conservation improvement plan that:\n(1) is devised by the authority to achieve a plan or purpose for which the authority is created; and\n(2) contemplates improvements that are to be supervised by the commission under general law.\n(b) Before the authority establishes a diversion point or constructs a canal, pumping plant, or other work under this chapter, the authority must:\n(1) present the plans and specifications for the project to the Texas Commission on Environmental Quality; and\n(2) obtain the approval of the commission.\nActs 2003, 78th Leg., ch. 1277, Sec. 1, eff.
