Special District Local Laws Code § 8834.104","heading":"ANNUAL GROUNDWATER WITHDRAWAL DETERMINATION.","body":"(a) The board shall hold an annual hearing to determine the effects during the preceding calendar year of groundwater withdrawal on subsidence in the district.\n(b) At the hearing, the board shall consider information provided under Sections 8834.107 and 8834.214 and information presented by persons appearing before the board.\n(c) After the hearing, the board shall:\n(1) consider all information presented to it;\n(2) determine groundwater withdrawal in the district during the preceding calendar year; and\n(3) make findings on the effects during the preceding calendar year of groundwater withdrawal on subsidence in the district.\n(d) The board's findings and determinations under Subsection (c) shall be included in a report adopted by the board. The report shall be made available for examination by any interested person.\n(e) The board shall submit the report adopted under Subsection (d) and a copy of the most recent district plan adopted under Section 8834.101 to the appropriate regional water planning group.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 1139 (H.B. 2619), Sec. 1.05, eff.
