Special District Local Laws Code § 8834.202","heading":"CERTAIN GROUNDWATER USES EXEMPT.","body":"The permit requirements of this chapter do not apply to:\n(1) a well regulated under Chapter 27, Water Code;\n(2) a well that:\n(A) has a casing with an inside diameter of not more than five inches; and\n(B) serves only a single-family dwelling; or\n(3) a shallow well that:\n(A) is not used to provide water for:\n(i) human consumption;\n(ii) agriculture;\n(iii) manufacturing or industry; or\n(iv) water injection; and\n(B) withdraws water solely:\n(i) to prevent hazardous sand boils, dewater surface construction sites, or relieve hydrostatic uplift on permanent structures;\n(ii) for groundwater quality analysis and for monitoring migration of subsurface contaminants or pollution; or\n(iii) for recovery of contamination or pollution.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 1139 (H.B. 2619), Sec. 1.05, eff.
