Transportation Code § 203.034","heading":"RIGHT TO ACCESS; DAMAGES FOR DENIAL OF ACCESS.","body":"(a) An owner of real property adjoining a new controlled access highway location is not entitled to access to the new highway location as a matter of right.\n(b) Denial of access to or from a new controlled access highway location is not a ground for special or exemplary damages unless:\n(1) in connection with the purchase or condemnation of the real property adjoining the new controlled access highway location and to be used in the new highway location, the commission specifically authorizes access to or from particular real property adjoining the new highway location; and\n(2) the commission denies highway access to or from the particular land where the real property adjoins the new highway.\nActs 1995, 74th Leg., ch. 165, Sec. 1, eff.
