Transportation Code § 311.032","heading":"ESTABLISHMENT OF FREEWAY.","body":"(a) The governing body of a municipality may establish, maintain, and operate a freeway.\n(b) To establish a freeway by using a street that exists at the time of the establishment, the municipality must have the consent of the owners of lands abutting the freeway or must purchase or condemn the right of access to the abutting lands. This subsection does not require consent to establish a freeway for the first time as a new way for vehicular and pedestrian traffic.\nActs 1995, 74th Leg., ch. 165, Sec. 1, eff.
