Transportation Code § 366.164","heading":"RIGHT OF ENTRY.","body":"(a) To acquire property necessary or useful in connection with a turnpike project, an authority may enter any real property, water, or premises to make a survey, geotechnical evaluation, sounding, or examination.\n(b) An entry under Subsection (a) is not:\n(1) a trespass; or\n(2) an entry under a pending condemnation proceeding.\n(c) The authority shall make reimbursements for any actual damages to real property, water, or premises that result from an activity described by Subsection (a).\nAdded by Acts 1997, 75th Leg., ch. 1171, Sec. 7.24, eff.
