Transportation Code § 623.104","heading":"CIVIL AND CRIMINAL PENALTIES.","body":"(a) A person commits an offense if the person violates this subchapter. An offense under this subsection is a Class C misdemeanor, except as provided by Subsection (d).\n(b) A person convicted of an offense under Subsection (a) may also be assessed a civil penalty of not less than $200 or more than $500 for failure to:\n(1) obtain a permit;\n(2) have a required rotating amber beacon on the manufactured house or towing vehicle;\n(3) provide a required escort flag vehicle; or\n(4) have the required insurance.\n(c) The civil penalty:\n(1) may be awarded by a court having jurisdiction over a Class C misdemeanor; and\n(2) shall be paid to the county in which the person was convicted.\n(d) Except as provided by Subsection (e), if the offense involves the movement of a manufactured house over a highway, road, or street in this state without a permit issued by the department, the offense is a misdemeanor punishable by a fine of $1,000.\n(e) If it is shown on the trial of an offense punishable under Subsection (d) that the defendant has previously been punished under Subsection (d):\n(1) one time, the offense is punishable by a fine of $2,000; or\n(2) two or more times, the offense is punishable by a fine of $4,000.\nActs 1995, 74th Leg., ch. 165, Sec. 1, eff.
