Transportation Code § 623.148","heading":"LIABILITY FOR DAMAGE TO HIGHWAYS.","body":"(a) By issuing a permit under this subchapter, the department does not guarantee that a highway can safely accommodate the movement.\n(b) Except as provided by Section 621.207, the owner of a vehicle involved in the movement of an oversize or overweight vehicle, even if a permit has been issued for the movement, is strictly liable for any damage the movement causes the highway system or any of its structures or appurtenances.\nActs 1995, 74th Leg., ch. 165, Sec. 1, eff.
