Transportation Code § 623.195","heading":"RULES; FORMS AND PROCEDURES; FEES.","body":"(a) The board, in consultation with the commission, by rule shall provide for the issuance of a permit under this subchapter. The rules must include each matter the board and the commission determine necessary to implement this subchapter and:\n(1) requirements for forms and procedures used in applying for a permit;\n(2) conditions with regard to route and time of movement;\n(3) requirements for flags, flaggers, and warning devices;\n(4) the fee for a permit; and\n(5) standards to determine whether a permit is to be issued for one trip only or for a period established by the commission.\n(b) In adopting a rule or establishing a fee, the board and the commission shall consider and be guided by:\n(1) the state's investment in its highway system;\n(2) the safety and convenience of the general traveling public;\n(3) the registration or license fee paid on the vehicle for which the permit is requested;\n(4) the fees paid by vehicles operating within legal limits;\n(5) the suitability of roadways and subgrades on the various classes of highways of the system;\n(6) the variation in soil grade prevalent in the different regions of the state;\n(7) the seasonal effects on highway load capacity;\n(8) the highway shoulder design and other highway geometrics;\n(9) the load capacity of highway bridges;\n(10) administrative costs;\n(11) added wear on highways; and\n(12) compensation for inconvenience and necessary delays to highway users.\nActs 1995, 74th Leg., ch. 165, Sec. 1, eff.
