Transportation Code § 91.036","heading":"EXPENDITURE OF FUNDS.","body":"Subject to Section 91.071(b), the department may receive, accept, and expend funds from this state, a federal agency, or other public or private source for:\n(1) rail planning;\n(2) studies to determine the viability of a rail facility for rail transportation service;\n(3) studies to determine the necessity for the department's acquisition or construction of a rail facility; and\n(4) the acquisition, construction, maintenance, or operation of a rail facility under this chapter, including the assessment and remediation of environmental contamination existing in or on a rail facility.\nAdded by Acts 2003, 78th Leg., ch. 1325, Sec. 4.01, eff.
