Utilities Code § 181.065","heading":"PENALTY.","body":"(a) A telegraph company shall comply with an order of a municipality's governing body or a commissioners court requiring the company to arrange for transfer of messages.\n(b) A telegraph company that fails to comply with an order is subject to a penalty of $10 for each day of noncompliance, payable to the state. The county or district attorney may bring suit to recover the penalty.\n(c) A penalty may not be imposed against a telegraph company for noncompliance with an order if:\n(1) the company is prevented from making a connection through the fault or omission of another company; and\n(2) the fault or omission causes the company's failure to connect.\nActs 1997, 75th Leg., ch. 166, Sec. 1, eff.
