Utilities Code § 39.605","heading":"DEFAULT CHARGES NONBYPASSABLE.","body":"An order issued under Section 39.603 or 39.604 must:\n(1) include terms ensuring that the imposition and collection of default charges authorized in the order shall be nonbypassable by wholesale market participants; and\n(2) authorize the independent organization to establish appropriate fees and other methods for pursuing amounts owed from entities exiting the wholesale market.\nAdded by Acts 2021, 87th Leg., R.S., Ch. 908 (H.B. 4492), Sec. 5, eff.
