Utilities Code § 39.656","heading":"UPLIFT CHARGES NONBYPASSABLE.","body":"An order issued under Section 39.653, 39.654, or 39.655 must:\n(1) include terms ensuring that the imposition and collection of uplift charges authorized in the order shall be nonbypassable, except for entities excluded under Section 39.653(d); and\n(2) authorize the independent organization to establish appropriate fees and other methods for pursuing amounts owed from entities exiting the wholesale market.\nAdded by Acts 2021, 87th Leg., R.S., Ch. 908 (H.B. 4492), Sec. 5, eff.
